Thai Power of Attorney

There are various occasions when a Power of Attorney is necessary. For example, you may wish to sell your condominium in Thailand and you are not available on the transfer date so you need to authorise your agent, representative or lawyer to carry out the transaction for you. However if the power of attorney you have given to your agent is not created according to the law and is not in the required format, a government official may not accept it.


According to the Civil and Criminal Code, the agent who has a general authority may do all acts of management on behalf of his principal. However, he cannot do such acts as:

  1. Selling or mortgaging immovable property.
  2. Letting immovable property for more than three years.
  3. Making a gift.
  4. Making a settlement.
  5. Entering an action in Court.
  6. Submitting a dispute to arbitration.

Additionally, if you wish to take legal action in a civil and criminal court, you may appoint your lawyer as your representative to conduct any secretarial activities (for example, to sign some relevant documents for the case, to collect returned court fees or to give statements on your behalf in order to save time and costs for unnecessary trips to Thailand).

However, it should be noted that for witness hearings if you are required to give testimony, a Power of Attorney may not be an option and it is within the Court’s discretion whether to allow you to authorise your agent to give testimony on your behalf.
